i want to buy a better phone and let my daughter have mine - im in contract with carphone ware house but i use 02netwrk - my upgrade for another 13 months but would buy a new phone and set a 02 sim for my daughter .

Hope I understand your question ... are you saying you have a contract with The Carphone Warehouse, and you dont receive your upgrade for 13 months...
and your contract ties you to o2.
If so then Buy yourself a new phone and put your existing sim into it. The new phone will need to be on .. o2 .. unlocked or even a Tesco phone will work with your o2 sim.( Unlocked phones are also known as sim free phones. )
Then give your old phone to your daughter and get her a sim only contract with o2, or an o2 PAYG sim for free. http://freesim.o2.co.uk/unlimited/clean
