myself and my husband have recently seperated, and are in the process of selling the marital home. he is trying to hold up the sale until i agree to pay half of the mortgage payments(which is in his name) for the time i was living elsewhere. his lawyer is threatening me with court, can he do this??

Are you claiming a portion of the equity of the house when it is sold?

yes, my husband agreed to split profit of flat 50/50, but is wanting to claim the mortgage payment for the time i wasnt there from that.
I assume you will be screwing him for your half when the house is sold so why shouldn't you pay half while its not?

I suppose it's all only in his name when it suits you, but as soon as it's sold it will become "the marital home" again and you will be demanding your cut.

considering you don't know the full story my husband insisted that it be in his name only and that it was purchased at the marital home i am sorry if you have been screwed over by your i assume ex wife but there is no need to take that out on me, i only asked the question so i can figure out where everyone in my situation stands, but it is clear you hate woman kind as a whole.
im a woman (though i dont see what gender has got to do with it really) and I have to agree that If you are wishing to claim half the equity then you should pay half the payments.

If the main value of the house had increased whilst you were away I bet youd be happy to accept half the equity in that time
When me and my ex seperated I left the marital home and it was put up for sale. I had two choices, firstly carry on paying half the mortgage and then when the sale completed 50/50 split. Secondly, I could have refused to pay my share of the mortgage until the house was sold however the amount that I "owed" would then have been taken of my 50% so really either way you will have to pay.
Difficult to hate women when I am one, perhaps we should sign each answer so people know which one of us is replying. My hubby did get ripped off by his first wife but that is not the source of my comment.

My answer still stands, when the house was bought you would have known that it didnt matter whose name it was in and you would be entitled to half. Whether you live in an assett or not is irrelevant surely uf you intend to profit from it you should also pay the price of it. I'm not having a go but why should you expect the rewards without paying the price?

as i said previously you don't know the full story and there has been a lot of back tracking on his part i have been upfront the whole time and now he is just out to get money as he wants to leave the country.
can only advise you on what you write, not a backstory but yes, he can (and should) take you to court if you refuse to pay for soething you later (when sold) want 1/2 of

ok i never once said i have not agreed to anything so why the judgement i asked a simple question to being with all i wanted was an answer and not to be judged.

There are many factors involved with this. You could argue that although your husband has paid the mortgage you have moved out. Your husband has had sole use of the property and you have had to pay rent elsewhere so there fore dont have to pay your half of the mortgage payments as you were paying rent.

I would see a solicitor if i was you.
