I run a pub and I want to assign the lease. The brewery went bust and surrendered the lease so I am now trying to register the new lease between me and the landlord. Landlords solicitor is not providing the necessary docs - can I sell the lease and the new leaseholder register the lease or do I have to register if first then sell it?

You don't say if the brewery owned the lease or not.

Usually when a business goes up the swanee the administrators or liquidators take the lease as it is an asset in the name of the bankrupt business. If it is worth anything they keep it and sell on the premium, if not they relinquish it as they won't make any money out of it. in today's envoronment, hardly likely!

thanks but Yes they surrendered the lease in September so now I have a lease between me and the landlord so therefore I have no more involvement with the brewery and need to gain an answer to my problem
Speak to your Local Land Registry Office about registering the lease. They are very helpful and you can find your Office here http://www.landregistry.gov.uk/regional/office s/
If there is difficulty in registering your lease you really have nothing to sell until it is cleared up. Whilst speaking to the LR ask about registering a Caution on the property to protect your interests whilst the matter is resolved.
