I have an 18 month contract with vodafone but i recently change my direct debit details, vidafone took it out on the wrong date and as a result my bank charged me, i paid the amount on a card but they then tried to take the dd out on a further date incurring me more bank chares, this is the 3rd time in a yr they have done this and they only ever credit my bill instead of refunding the charges via cheque or otherwise.
Am i within my rights to canx the contract since they are obviously not capable of using a direct debit facility?
I am only 9 months into my contract but i am so unhappy with them as they are costing me far too much money as a result of their error.

I doubt if you can cancel the contract.

However you can ask you bank to refund all the wrong direct debits and the charges.

It will probably cause you even more problems with Vodaphone though.

Thanks for that!
I am going to look into it or speak to trading standards as surely this is not giving me a god reputation with my bank!
Thanks for taking the tim to answer my question though!
one thing you have to consider is that your credit score with your bank is going down everytime they charge you, which is something vodafone cannot refund!
Get your unlawful bank charges back as well from the bank - along with the past six years worth.
A contract is two sided and Vodaphone need to provide a service to you. If they do not provide this service then they have broken the contract and this will allow you a get out.

Other mobile phone companies may buy you out of the Vodaphone contract if its not too much.

Good luck

Law man 1856-Thank you for that its certainly made me feel more confident about the get out clause!
I put my complaint in writing last Tuesday and have not heard a thing this is now mon the 30th so if they do not reply within the 5 working days there'll be more reasons for me to get out!
I've never had such a bad experience with a company before so the quciker i get out for me and my reputation with my bank the better!
Thank you all for replying!
first off if you have a direct debit set up,why are you paying via a debit card..?.

If the bank charges are applied as a credit on the account,You can have the amount sent out via a cheue or refunded onto a debit card. This can be requested by you

Vodafone are the 4 largest company on the stock exchange and the 10 largest company in the world so i would think they know the banking system pretty well

You will have to pay an early termination fee if you have 9 months to go on the contract,it will be 9 times your monthly line rental

If you left the monthly amount to go out via direct debit and didnt start messing around caling up to make payments none of this would happen.fair enough they should advise you of the date of which the direct debit comes out,Which they do.the date appears at the bottom of your monthly bill or if you speak to a lovely advisor they will tell you .

you can cancel your direct debit and not pay them,However defaulting on your account will show up and you will have problems getting credit in future
