Can I leave my husband?

My husband and I want to seperate, I have the tenancy in my name and I have been completely reasonable with him regarding seeing his three year old daughter. He is verbally horrible to me and making my life hell at home, he is adamant that he will not move out because he says that he has 100% Control over our three year old. Am I within my legal rights to terminate my tenancy and move me and my three children away from him as my heart (Health problems) have started to get really bad

No. You've got it the wrong way round. If it's your tenancy, in your name, then he stays there with your permission. You can, in theory, ask him to leave at any time and he will have few rights.

If you ask him to leave, he may not agree. In that case you would be entitled to ask the police to attend if there were threats to you or your family.

Who's your landlord (private or housing association)? A housing association might offer support services to help you eject this man to protect your family.

Contact one of the single parent support organisations for more practical support in your area.
