Capping claims will ( for less serious injuries ) will undoubtedly lower costs to the industry

//Capping compensation would see the average payout cut from £1,850 to a maximum amount of £425, and it would only be paid out if a medical report was provided as proof of injury.//

1.In my experience , the percentage of payouts without medical evidence is small .

2.Obtaining medical evidence is not going to deter claimants , because it is the defendants who have to cough up for the costs

3. It is very difficult to disprove that a claimant is not suffering from whiplash ( back / neck pain )
I i say to the examining doctor that my neck hurts - it's impossible to prove that it doesn't .

//Rob Townend, claims director at Aviva, said: "These proposals bring us a step closer to saying good riddance to the 'whip-cash' merry-go-round that is the bedrock of the UK's compensation culture."//

I don't see how that claim can be made .
However the capping will certainly reduce the overall costs .

Whiplash should be deemed to be an accepted risk that can't be claimed for.
I know that whiplash can be very painful and the effects can last for months, but so can twisting an ankle when a woman wears high heels.
1100% agree ymb.
I'll see your 1100% mikey and raise you to 1200%. !

In all fairness though, as usual the genuine cases will suffer. Better to jail any false claimants in my opinion.
The fraud that has been gong on with whiplash, has been happening for years, and there are a lot of guilty people involved, not the least the medical personal who have been signing all the documents.
//...not the least the medical personal who have been signing all the documents.//

Medical opinion is that whiplash can be caused by a low velocity impact .
So the medical personnel in his/her reports cannot say that a person presenting themselves, is faking a hurting neck / back
I never met Cynthia Payne; she died last year, almost to the day :o(
Dodgy doctors.
Dodgy lawyers.
Dodgy patients.

Doctors get at least £300 for the medical report.
Lawyers get a nice earner.
Patients can get a windfall of up to £4,000 or thereabouts.

How can these plans filter out the cheats?

Also whiplash injuries can cause serious disabilities.......a sort of concussion....headaches, dizziness and limb weaknesses.
This is where the On Board Camera comes in Young, the sooner they legalise these the better.

Didn't realise they were illegal.
On board cameras are illegal????? I thought you had one TWR, you surprise me turning your back on the law :-(
Should I have said it should be a legal requirement to have them fitted, does that sound better.

lol - Yes i did suspect quite a 'few' of those mentioned , when i was dealing with PI claims
I wonder what the penalty is if you are fiddling with your camera and you have an accident?

Automatic ban?
Any person with a bit of sense positioned their camera, that is, some people.
ok gotcha

///Any person with a bit of sense positioned their camera, that is, some people///

Could you possibly explain that plase?
Spelling error????
My OBC are positioned so they have no need to be altered.
My dashcams are hard wired and never moved.
