Is it rented from them, they can insist if one was there before. Or could be a covenant in the deeds stipulated when planning permission was given.

i think it's possible.
If it was his own house, then i would say not true but as it's not his, there might well be something in the contract. Also, if he has any dogs he has to keep them in
