Well Evian you're entitled to your opinion. I asked as my parents (in South Africa) tell me it's on all the channels there and he lived ins hated community which means before she got access to the property he would have been made aware by security. I guess in uk most folk aren't aware of gates community protocols.

It would be a variant of the Tony Martin defence who shot a burglar in the wrong part of his body, and depending on the facts (decided by the Jury) may succeed.

Ive just viewed the live police statement (channel 517 sky enca news) police will oppose bail strenuously. Police deny the rumours of mistaken for burglary. He has been taken for blood and drug alcohol tests. Previous "incidents" of allegations of domestic violence had been reported officially to police from his address. Also last night (a few hours before) neighbours reported domestic dispute. Police say Oscar pistorius did not state suspected burglar to them. Now this is NOT to say he's guilty but rather to say what the live police statement has said (channel 517 sky) as bbc might take a bit longer to update.
