hi


i have a right nightmare with the executers of my relatives will. she sadly died last january 2005 and its been 13 mths and still no sign of the 2 items i was left in the will. i have called endless times and these two women executing it blatanly lie to me about the biggest load of rubbish and will not meet with me. i live 5 mins away from them !


how long do they have to execute a will ?


where do i stand legally?


What can i do if they have sold the items (i think this has happened personally)

The wills executors have a legal duty to ensure the bequests in the will are carried out. Seek professional advice from a solicitor. A letter from him/her will probably be enough to motivate them into action. A letter won't cost too much either. If they have sold the property without your consent it constitutes theft, and at the very least you will be entitled to the proceeds of the sale but again a solicitor will advise you.

Traditionally executors have a year, but I don't think it has any legal force. It's as long as it takes.


If they have sold them then you are entitled to the proceeds. If your relative disposed of them prior to death then you are not entitled to anything. Proving which event occurred could be difficult.
