My husband and I are tenants of a local council and our 18 year old daughter is also on the tenancy.
Recently she has started work and has become a non dependant, and our housing benefit has been adjusted accordingly.
Just recently, our daughter has started spending 4 or 5 nights per week at her boyfriends house, are we breaking any laws or regulations by not informing the council. As is this still classified as her main dwelling?

Your house is still her residential address , the one on her bank account for instance and I presume she is on the electoral register with you at your home.
So you do not need to tell the council, the BF may not last long anyway .
There is a 13-week rule for temporary absence, you can get HB for up to 13 weeks during a temporary absence if:

You intend to return.

The property is not sub-let.

Your absence is unlikely to exceed 13 weeks.

I think eddies 51 is correct, and remember this is 13 continuous weeks not just a few days at a time.
I don't think tonywiltshire's point is relevant to you. The HB claimant is you or your husband. What he is saying applies to a situation where the claimant is away from the home.

You do not need to tell the Council, but do remember that if she moves out (i.e. goes to live with the boy friend or someone else) then you do need to tell them because the non-dependent deduction from your HB would then stop.
The daughter is a non-dependant who is on the tenancy agreement and is entitled to be away on a temporary basis, you are correct themas that if she leaves the situation changes. The tenants will be under an obligation to notify the LA of all changes to those who live at the property, but if she is only away for short periods this will not apply.
They also ask if this (their home) will be their daughter’s permanent address and based on the 13-week rule I would argue that it is.
I believe it too be wise to keep the LA informed of the position if they are concerned.

the council has given me tempery flat to stay and found out that 4 years ago my farther sked me keep money i my account but i gave it back to my father ever penny.
And i have bank proof to show that i have returned the money back, and now is not to proof.Now hes passed away 3 years.I have two daughters and im worried where would i take them,Plaese help.
