If my husband walks out from our marital home, can I ask for his keys or change locks ?

From memory, if he has lived in the house for more than a year (possibly 18 months) he has legal rights to the property. Best thing to do would be to take legal advice.


If he is violent or you fear him returning and damaging the property and/or threatening you, I would advise that you change the locks anyway. If he wants to gain access you will need to permit it though, although it might be worth calling the police (on the local number, not 999) to see if they can attend at the same time, just in case.

My friend recently split up with her boyfriend with whom she'd bought a house. When thay spilt she changed the locks as her was coming and going all hours of the day. Anyway, he forced entry into the house by breaking a window, and the po;ice told her other than potentially criminal damage no crime was done! She's had to take an injunction out on him for harassment to keep him away!
