I was checking a endorsement code for my son for insurance purposes. His last was CU80 using mobile phone whilst driving in 08.He was given 3 points for this But on asking him he said at the time, he was stopped for breaking the speed limit (they said he was doing 60 in a 50) on a short ( 800mtrs) stretch of urban dual carriage way, which he disputed in court at the time ,but they still endorsed him.
Seeing as they could not prove conclusively he was breaking the law they made this up?
Is there a procedure for looking at this again, or should he just forget it seeing as so long has passed.

If the offence happened in 2008 then he can have the endorsements cleared from his licence.
No point worrying about it now it's over 5 years it no longer has to be disclosed to the insurance. It is probably just a typing error anyway.
so he was stopped for speeding but prosecuted for using the phone?? There must be more to this, they don't just make up charges in court.
Appeals against convictions in the Magistrates' court have to be lodged with the Crown Court within 21 days so I'm afraid your son is slightly out of time.
