He's detained under the Mental Health act. Biggs was convicted and then escaped from prison.
No-one should be exempt from re-capture however long it takes especially from a secure hospital, hope to goodness it isn't around here.

Ah, was he not convicted first then? Or doesn't that matter.
That is terrible. And a medium security hospital for a mentally deranged killer! I find that deplorable.
He was convicted - of manslaughter on the grounds of diminished responsibility. I assume he was given a Hospital Order of an indeterminate length. He can be re-arrested.
Why would anyone think that if he evades capture for a certain length of time he can't be detained again?

He's been caught now.
I think there was a time when if someone escaped from an asylum and managed to stay free for a while they weren't rearrested. I suppose it was thought if they could manage outside the asylum then they didn't need to be returned to it.

The cant be rear rested and charged. They are detained and returned to the hospital under the terms of the section.
