My husband divorced me last month and we still have a matrimonial home that is jointly owned. I put in 61% of the deposit into the house and he put 39%. There is only about £5,000 equity in the house which is less than my ex-husbands deposit. We have had the house for 2 yrs now. The 1st year we both paid 50% each of the deposit considering that he moved out 1 month after we bought the house and paid nothing in the 2nd yr. I paid the full mortgage alone and all the bills. I want the house to be transferred to my name and my dad’s but I know that my ex -husband won’t agree to this as he owes me money for not paying his share of the mortgage in the 2nd yr which is also more than his share of the equity. Would the court grant me the house even if my ex husband doesn’t agree to the transfer? I am 26 he is 29. I earn more than my ex husband and we were married for 6 years and together for 4.5 years. I have lived in the property now and since we bought the house. My lender has already agreed for my dad to join me on the existing mortgage. I am not going to remortgage just merely do a change in equity (change of names). What are all my options?

I got confused where you said the figures 39 and 61% but then changed it to 50-50.

anyway, did you have anything written into your deeds when you purchased the house? Did the solicitor confirm there was a split in the equity due to differing deposits?

I think you need to see a solicitor.

you need to come to some agreement asap with your husband, there was a story in paper recently where a woman who had paid the mortgage alone for something like 30 years was ordered to pay a substantial amount to her ex.
can you make your Ex an offer??? to buy him out??

Oh sorry.

The 1st year we both paid 50% each of the mortgage considering that he moved out 1 month after we bought the house and paid nothing in the 2nd yr.
