Can the police keep my arrest on file?

Just over 5 years ago i got really drunk and done something drunkenly stupid and was arrested for it, i was charged with criminal damage an given an £80 fine which i paid straight away, i was not charged for the the main thing that i was arrested for as the police knew i was so drunk that i couldnt even hardly walk or talk never mind do the crime, and i never knew why i had been arrested the next morning when waking up in the police cell, i had to ask the policeman why i had ben arrested. (the charge was burgalry as i had somehow mistaken my ex girlfriends neighbours (a few doors up) house with her house and gone in there an got my head down on the couch, no breaking an entry or nothing and everyone puzzled as to how i got in, including me) anyway since being pulled by the police twice in the last year, once on my bike an once on in my car. when they do a name check on me, the mood turns nasty as burgalry is showing up on my name along with criminal damage which i accept, but am i entitled to get the burgalry charge or whatever it is scrubbed completely as i wasnt charged for it and dont wish to be treated like a smack head by the police when i am in fact a hard working citizen who messed up one night through too much drink! cheers for any advice

If you go to the station or write to the force explain that you wish to seek clarification on the recording of this burglary arrest because of your concern's as stated in your opening post.

Just to summarise first: (obviously I cant say to much on here).

Just to clarify folk's, entering a house even by force does not always amount to burglary
No Stoke, I wouldn't like it but as Kev said, he was so drunk he mistook the house for his girlfriend's place which was a few doors down. He had no intention of causing distress - didn't even realise he was in the wrong house.

We've all done daft things when drunk. If it had been my house, I would've been scared initially, yes, of course I would, but would understand and forgive him.

Stoke, im no burglar, the criminal damage was due to me hanging off a trucks wing mirror and braking it off,it was described that i was cuddled up to the wing mirror on the couch as if it was some sort of teddy of mine! Believe me there were tears of laughter at the police station the next morning, even the sgt was in tears and i even seen the funny side myself and ended up laughin my tits off too! im pleased to inform you that the £80 fine was used to replace the mirror on the truck which happened to be outside my ex's house, so it all happened there really, but even to this day i dont remember any of it and it was the first time i had drank in 8 months so that probably didnt help matters. anyway thanks all for your input and especially you ex. peace

i didnt want to appear to be argumentative mrsc but i have been the victim of a break in and im sorry but i dont find it funny in the slightest,whether he was drunk or not,oh well lets hope kev has learned his lesson..best regards..
Mrs C. - I have never been drunk and so never done anything stupid under the influence. However, I have done lots of stupid things while sober, fortunately nothing criminal.
However I agree with stoke, and I must say that if I found someone strange in my house I would freak out. Kev would not have escaped unscathed.
Stoke, I have been the victim of a break-in by a burglar and it was truly horrible. But the OP didn't break in - he says in his original post, everyone was puzzled as to how he actually got in, there was no breaking and entering. Perhaps the householder forgot to lock the door, then felt too foolish to admit it? Easily done. I've done it myself, many times.

I think it's very unkind to liken him to a burglar, which he clearly isn't. He'd had a skinful and got the wrong house. Listening to what Kev has told us, I am amazed the word "burglary" was used. Sounds ridiculous to me.

Starbo, would you honestly attack someone sleeping on your sofa? Or someone who is staggering around? (I think it's safe to assume he was). I don't think you would. You'd be frightened for sure, but I doubt that you'd wallop him.
Getting back to Kev's original question.....is he entitled to get the burglary slur on his character removed completely?

I'm no expert on law but I would think burglary fits the same criteria as theft - that is, taking something with the intention of permanently depriving the rightful owner of it.

Kev had no intention of taking anything from the house, yet he now has a 'dishonesty' tag attached to his record. How unfair is that? Could cause all sorts of problems when applying for jobs too. I feel sad for the lad. In circumstances such as this, I think it would be fair to have the word 'burglary' removed from his record. I don't think his request is unreasonable. After all, he is not a burglar.
