Boundary line and parking space/drive

My neighbour is buildng a house in his side garden, the 1m boundary for either party has been adhered to in all areas except the driveway which to get the correct size for a parking space he has had to go right up against our fence (which is 1m from our house and my daughters bedroom window, although at a different level). does the 1m boundary rule not count in the case of drives/parking spaces?
