Hey people,

Just like to say that other threads on Police cautions have influenced me trying to fight my girl friends caution.

So any advice would be hugely appreciated. Smile

A little background:

My girlfriend received a caution for ABH in October 2006. She had been out to celebrate her birthday with friends, had hardly drank and was in a club when the incident occurred.

Whilst consoling a friend in a toilet cubicle, a bouncer entered accused the pair of doing drugs and physically threw my girlfriend out of the club - gracefully throwing her down the stairs in the process.

Trying to get her coat before she left, the same bouncer grabbed her round the upper body and neck, so she bit him.

The police were called, the bouncer came out with a bandage on and she was arrested. Now she had no previous record and had recently started working towards her degree in mental health nursing. She was worried it would effect the course and her career but the police told her it wouldn't, well it has...

A few weeks ago after almost 2 years of the degree complete, she has been asked to leave university. With a 2:1/1st average and glowing reports from her NHS placements, she is now left in the cold.

The university fought her case and appealed that the NHS Primary Care Trust (PCT) were harsh being that she was a great student and the people in industry she had worked for had always been so positive about her ability as a nurse.

Now, there are people on the same course who have similar cautions or convictions and still remain on the course, as the PCT aren't aware of such things as the university apply for the CRBs when students apply for the course, but don't tell the PCTs were the students do 50% of the course.

It only came to light when she applied for a part time job in the PCT to supplement her measly �140 a month NHS

I too have been put in a similar possition. The caution was over 3 years ago but it has bugged me ever since. I was also advised by the officer it would not show up if checked by an employer. Can you tell me how you are getting on with removing the caution. I didnt know this was possible?

Did you say that the caution was 2 years ago? if so you've only got 3 months from the date of the caution to take it to the court of administration in london to get it rescinded, or you've got 12 months from the date of the caution to complain to the police station in which the caution was given in order to get the caution rescinded, after this you can't do anything.

IF you had taken this to a solicitor within this period you could've applied for the caution to be rescinded based on the grounds that the police didn't follow procedure when giving the caution. Believe me i've had a caution, did this and had it rescinded simply based on the police not following procedure. For a caution to be given you must admit the offence, the officer must explain the implications of a caution, eg not being able to get a job working with children, vulnerables (mental health patients) etc. What you must remember is, although they are a police officer, unfortunately for all of us they don't know the law, and hundreds upon thousands of young people are being criminalised falsely and getting away with it simply because the police aren't following procedure and simply doing what the hell they like. the only advice i can give you is continue in a course that doesn't result in working with any categories that you need a CRB check for, get a job and then after 5 years the caution should be spent on your girlfriends record and won't affect her applying for jobs after that.

I going through the same problem after a argument with my husband 3 years ago. I found out he had 'been' with another man, he pinned me to the wall and I slapped him. The police were called and I totaly cooperated and was honnest. They told me I was being releast with a caution and was told it wouldnt affect any job as its only a police record. After applying for a job that required a CRB it came back saying I have a caution for Battery! I was so shocked and ashamed. I made some enquires and was told that it would be removed after 3 years but i now know that is wrong. A caution is never removed from the CRB. I dont know what to do :-(
Hi, I was wondering if you had any luck removing your caution? I was told explicitly that mine would go after 5 years but there has been new developments since (google: 19th october, 2009 judgement by court of appeal) which stop the step down process. It's sad really because I will now spend a lifetime paying for a minor petty theft incident which happened at a really low point in my life-this is after 5 years of med school and a huge debt! The Medical school knew as did my first employer, they had no worries and understood the circumstances, but job options will be limited for me from now on unless its removed from CRB checks.
