I am due in crown court monday (1st nov) For a case plea hearing. However my husband is surpose to withdraw his statement. Will it still go to trail ? Thanks

the charge is gbh. Will my solicitor be notified by the police to say that he has dropped the charges ? Should i mention his intention to drop the charges to my barrister on monday. I met with the barrister for the first time mon. Only iam not allowed any contact with my husband (part of bail conditions) He has been calling me. Advice please !
I would expect that as the charge is GBH and this is maybe a domestic violence related assault that the police and CPS will continue with the prosecution regardless of whether you husband retracts his statement.
i have been in a similar situation my self, my ex boyfriend and i had a fight, well i kept hitting him, he retaliated, but he did try to do the right thing and walk away, he was charged because of my mum ringing the polcice :@, he was charged with section 20gbh, due to me having a broken wrist, but i have managed to prove that he didnt break it, i broke it before we even started argueing, ( i fell out of a taxi), anyway the cps have agreed to drop the charges to section 39 common assualt, but there still pursueing that :/ iv tried asking the cps not to go ahead but as i have found out there is nothing i can do and they will continue it until the end, according to them its in the publics interest,so im sorry to say but yes it will definatley to trial at the crown court,

You will find that you will need to tell your barrister this information, you may find that when you appear at Court you will be asked to to plead gilty or not guilty. In your circumstances you will plead not guilty and your barrister will tell the court that the victim intends to withdraw his statement. The Crown Prosecution will then make enquiries to ascertain whether the charges are being dropped or not.
