does my ex have to pay towards the mortgage because his kids live there?

partner (not married) left 8mths ago. we have a joint mortgage. he is still paying half towards it. ive threatened him with csa a few times as hes been giving me £100 most weeks aswell for our 2 kids (age 1 and 2). still trying to get him to set up a dd for that. Things have come to a crunch point now and im unsure if by law he has to pay towards the mortgage as his kids live there too?? we wont make any profit off selling the house yet, infact more likely a £7000 loss. And where does that leave me if i have to sell??? Im terrified we will end up in a pokey flat. any advice would be most welcome, ive got an appointment with citizens advice but was wondering if anyone had experience in this?

You are both responsible for the mortgage as it's in both names.

So he's giving you £100 pw on top of half the mortgage payments?
It would appear you're doing quit well out of him then?!

I would try to formalise the payments either through the csa or courts.
well see what the CSA say, you may be surprised as others have said, lots pay too much in informal agreements
