if for example they have filled in the forms and after 3 months of waiting has been given the highest rate of mobility and care components but you know for a fact that they walk miles everyday to go shopping or just to get out and about, uses steps and stairs no problems and requires no care or supportt with bathing, dressing, toilet needs day or night...
i have informed my dad he is commiting fraud and o let them know, he just says i told the truth on my forms.
i know how hard it was for my nan to get these rates of dla and she couldnt walk, stand or get to the toilet and needed care around the clock.
moral and legal dilemma

if you look at what dla high rate mobility and carers allowance requirements are and then realise that he doesnt meet any of those requirements (i know 110% that this is so) then i know there is a mistake, be it genuine or not but by him not reporting it then thats fraud yes?
as for being close to retirement you still get dla if you claimed it before 65 but not after so he will be getting this benefit indefitnately until he passes
well report him then.
you're right in what you say, tweeny.. but it's not an offence to be a bystander. you're not obliged to report it, so it's your shout.

mmmmmm i dunno think i will have a long hard think about this moral issue
thanks to all though, i feel much better now i have gotten it off my chest
How the hell has he managed to get higher rate mobility allowance without a medical? I had to jump through hoops (not physically!) to get mine and had to have a thorough medical. It amazes me how some people can get anything that's going, but genuine claimants have to fight for what is their right. Report him.
I agree with kathyan. I had to have a medical and all manner of tests and examinations. Your father is committing a crime. You should report him today. It's not fair on people who need DLA and can't get it because of people like your father.
I was awarded higher rate mobility DLA plus lower rate care and I didn't have to go for a medical. In fact at the time I was still working almost full-time. It was awarded for "life".

After about a year the mobility problem eased a little and I withdrew my claim to DLA.

I still get incapacity benefit - legally. ;-)
joeluke... as long as the DLA is claimed before age 65 it will continue afterwards. You cannot make a fresh claim over the age of 65 for DLA but if I remember correctly you can claim for attendance allowance instead.
Surely when a man reaches 65 he draws his pension and that should supercede DLA?
