can any one tel me please my daughtes dad forign and he has her passport he wont retunr it can he be made under a residency order to return it julie

I don't know about the law regarding your question, sorry!!
However, I would reccomend providing more details to get the best possible answer, giving you all the information which is relevant to you.
I also would strongly advise going to discuss this with a solicitor a.s.a.p and I am 99% sure than regardless wether you qualify for legal aid or not, you get a 30min free consultation with most Solicitors. Citizens Advice will be able to help you and no appointment is needed. If you do see a Solicitor you may wish considering seeing a Solicitor that deals with Family law.

Also, if you haven't already done so it could be worth talking with your Daughters school to let them know only you will pick her up and not to allow her to leave with anybody else ie her Dad. Personally it's something I find something worth mentioning in these type of situations.

I'd be inclined to ask the court for a prohibitive steps order. If he is foreign and has her passport, the Court will act to ensure she can't be removed from the country.
I would report the passport lost to the passport authorities and it will get cancelled however ud have to pay for a new one issuing.
