My partner and myself ( unmarried) for 5 years are looking at buying a property in Poland. As a national to Poland she has rights to purchase with a small / no deposit, which in this climate is very appealing to be able to build a deposit for a house in the UK. Our aim is that we will both pay for the flat although it will be under her name. My question is : Is it possible to set up a legally binding co-habiting agreement in the UK which would give me entitlement to an agreed split of the property in event of sale, break up e.t.c?

thanks

Thanks for your comments. It isn't a scheme. Foreigners have to have a 25% + deposit to purchase a property abroad(its pretty standard), she still gets credit scored on only her income. If we had enough money between us for a deposit then i guess we would both go on the mortgage in Poland, so there's no 'jumping on' the ladder. Turning it around the other way ,if I was the sole person with the mortgage under my name in the UK, why couldn't we set up a cohabiting agreement where she gets half separate to the mortgage deed. The relevant point is there is quite alot of info available on UK 'co-habiting agreements but im not sure how binding it would be when relating to property rights abroad. Probably best I seek Polish solicitors advise but thought this site would be a good place to start for 'free'.
