A friend of mine resides in a flat with shops underneath and two flats above, they are all privatley owned and not ex local authority. For the past year everytime there is heavy rain water starts to pour in the living room and master bedroom. She called out a roofer and they believed that the problem was with the flashings on the upstairs flats dormer windows. The roofer would not do any work without the consent of the top two flats as he felt it was their responsibility to maintain the dormers. She therefore consulted with the upstair flat owners and they agreed to have the problem fixed. However a year on and she is still getting water dripping thru her ceiling evertime it rains, there is now considerable damage to her internal fixtures and she is unsure of how to proceed? She is willing to pay her share but she is unable to pay the total cost and as the problem does not affect the top two flats they keep fobbing her off with excuses like but we had it fixed (actually a mate looked at it and said it was fine, thats not fixing now is it?), it will cost too much etc. Also can anybody tell me is she solely responsible for paying for the repair to the inside of her property caused by the water? In Scotland you should contact your Local Authority(LA). They may be able to order the collective owners to undertake repairs by issuing a Statutory Repair Notice. Edinburgh City Council have this power so yours may also.
If the LA consider it an emergency they can commission repairs immediately and bill the owners later for their respective shares of the cost.
It will probably be the Planning Dept. or Building Control that you should speak to.
