With 9 points on my driving licence I have just received notice of a further speeding offence (39 mph ina 30 zone). I know this will mean a court appearance with a fine and or a driving ban. What level of fine and what length of ban can I expect? My first offence was in August of 2006 so I was very near to being down to 6 points, will this be taken into consideration.

The penalty will be a mandatory 6 months ban.
No idea about the fine.

Half a week's net income (reduced by a third if you plead guilty), plus about 60 costs (again, assuming you plead guilty, 15 Victim Surcharge, 3 penalty points and a minimum 6 months ban uder the totting up rules.

You may escape a ban if you can pursuade the magistrates that "exceptional hardship" to you or others will result from your ban.
You are obviously a serial motoring offender and deserve whatever punishment is deemed suitable.
Didn't you realise you were exceeding the speed limit and if so, why?
Apologies Malana but no sympathy from here.
Ask for a picture of the offence (without admitting you were driving, say its to identify the driver) and if the picture is just of the car and you cannot make out the driver then I have heard that some dishonest people have asked someone else to take the points for them i.e. get someone with zero points to say they were driving (make sure they would be covered on insurance), they would then get the 3 pts, you pay the fine and a bit extra for them and you still get to keep your licence

This is highly illegal and I am in no way condoning this but it does work without anyone having to appear in any court

Thanks New Judge for your answer, just the info I was asking for. Does,nt stop the moralisers creeping out of the woodwork though does it!!
you are meant to reply within 28days to the notice you receive, however if you ignore it you wont receive a court summons for another 6 months, as soon as your points come off in August return your notice and you'll get the 3 points which will take you back up to 9!

Doesn't work like that danchip as it will go by date of offence, not date of conviction.

Ignore the moralisers malana. No-one's perfect. I'm back down from 9 points to 3 (which will be off again soon).

Despite the protestations of the government and do-gooders, speed does not kill - it's **** drivers that kill people.

Speed accounts for a very, very small percentage of accidents, with the remainder being road conditions, poor driving skills, people on the phones, etc.

however, it would be a lot more expensive to have police patrols than to put up yellow boxes that flash you wouldn't it?

Plus the police patrols would also counter people speeding.

The claims I see are rarely (if ever) speed related, and generally fall down to a complete lack of concentration/awareness of the road ahead or the persons surroundings.

Rant over - everyone get back to their business : )
bit if a s hit driver hits someone at 20mph they have a far better chance of living than if that s hit driver hits them at 30 or more - bad drivers + speed kill, no two ways around it.

A good driver going at 50/60/70 will kill anyone he hits, probably
''so I was very near to being down to 6 points''

Ooooh... well done lol...
Got my son off this....

What's your occupation?

Thank you Tamborine, believe it or not I'm a company delivery driver and my job is driving licence dependant.
Bet you`re the typical White Van Driver. Sorry, but you deserve all you get. Think of the kith and kin of people who are left without their friends or relatives when they are killed by `Jack the Lad`s` exceeding the speed limits.
look on the bright side.. when you nearly get down to 6 points again, you can carry on speeding.
Presumably those who are considerably holier than me have never exceeded the speed limit. Or driven after a glass or two? Or had a peek (maybe a tiny little one, out of curiosity maybe) at an internet porn site featuring 'criminally obscene' material? Smoked (but not inhaled) a joint? Dropped a scrap of paper or a crisp bag in the street? Possibly more than once...
They're all potentially criminal offences, and most people reading this will have committed most of them, unless they've led an incredibly sheltered life.
I personally aim not to break speed limits, but it's time to get real and to stop getting on high horses and condemning people for what are, in reality, minor misdeeds.
