Hi, a friend of mine recently fell asleep at the wheel on a motorway at about 6am... She went up the embankment slammed into a tree but was only slightly hurt and didn't hurt anyone else thank god! The police have said she will be done for driving without due care and attention. What sort of penalty will she get and is it possible she could be banned? also could a solicitor help to reduce the sentence?

The penalty is between 3 - 9 points; a fine of up to �2500 and a discretionary ban.

How many people have been killed (even over this past week) on motorways by people charged 'without due care and attention'?

I know this is of no help to you but I hope she gets the book thrown at her.
Hi, I am not defending your friend in any way, but to the people who critisize this proble of sleeping whilst driving.
I had been driving for 38+ years on all types of HGVs as drivers of these things you get used to going long distances but can assure you it is common to do this, I used to travel from Lancs to Glasgow near every night & back within my hrs & break times there were many times when you were driving that you did not know where you where! ( you think i'm jokeing?) belive me Im not there were times on the motorway when the studs between the inside lane & hard shoulder had woken me up, you may think this impossible, If there are truthfull HGVs on the site wait for their honest replies. so before you start calling people for this problem think before you write (It may happen to you)
Yes, sadly I have been driving behind too many lorries that are drifting across the motorway or on to the hard shoulder.

A quick blast on the horn usually does the trick, but sometimes causes a nasty reaction with the driver jerking awake.

The fact that TWR finds it acceptable is quite terrifying
