Me and my boyfriend where aruguing the other night and hit bit me and I hit back. The neighbours called the police due to the noise. By the time the police arrive we had settled down and all was forgotten, but they still arrested him due to the bit mark on my arm and are now charging him with ABH.

I have not pressed any charges and dont want to. Why are they doing this. He is in court on Monday?

Can these charges be dropped? What will her get as hi is already on probation for driving with no insureance

Thanks

The driving with no insurance is irrelevant to the abh.

The police are doing this because ABH is illegal whether the 'victim' consents to the ABH or not.

He could go to prison, but more likely to receive a fine and community service.

Thanks for the reply.

Will the police drop the case if I go in and see them as I dont want to press charges at all!!

With his bail he is not even allowed to come to my home where he lives or speak to me so it have been very difficlut!
No, as I said, ABH is a criminal offence whether you consented to it or not.

You are not the one pressing charges, the police are.

I suppose you could speak to OiC for advice.

Sorry, the OiC is the police officer handling this case.

Phone the relevant police station and they will tell you who it is.

My ex partner is up for ABH on me police have told me hopefully he will get custodial sentence. He has been before magistrates and has now been sent to crown, they are making him attend court to answer bail every 2 weeks. He has gone not guilty I didnt press charges the police did they said if I didnt show in court I could be in trouble.
Perhaps you should both be charged with breach of the peace?
I was in a violent relationship untill last year and I finally plucked up the courage to flee to a refuge with my daughter after a nasty beating (I was pregnant and almost lost the baby) and I have not looked back! Because the police were called I did make a statement which I tried to retract as he did his usual "I will change" story but the police told me even if I retracted my statement due to the new domestic violence laws they would be taking him to court with or without my help. He is now up at the end of october on ABH of me ABH of my daughter both with intent, two counts of battery and perverting the course of justice for trying to get me to drop the statement.
I agree with raggy roman violent men dont change they just beat you and you forgive them untill they do it again. I learnt the hard way my daughter got hurt and my baby I was pregnant with when he beat me was born over 3 months early as a result and has lasting problems and spent the first 4 weeks of her tiny 1lb 15oz life fighting to survive. But it took that for me to leave him love is blind at times but if this is a regular occurance and you have kids then think twice as to what you are doing with him.
I am sorry if I have gone of the subject a tad here but no one deserves to be hurt by their partner ever and it upsetrs me to think that people are living like I did and never find the courage to leave. I hope this is not the case for you square but if it is there are places out there that can help you as they did for me 2 months in a womens refuge then being re housed may sound like a horrendous ordeal but compared to being beaten its easy.
I wish you luck in anything you do hun x x x
