Can one buy a property off one's spouse?

It happens all the time, for example in divorce settlements where one party wants to stay in the matrimonial home. one takes over the other person`s share of the mortgage and they reach an agreement on splitting the equity.

Basically anybody can sell anything to anyone as long as they legally own what they`re trying to sell.

Anyone with title over the property (eg your mortgage lender) would need to be notified, and they could get a court order to stop the sale if it affects their interests.

(For example, if the owner tried to sell the property to a partner for �1 to avoid repossession or such-like)
