If a tenant breaches their Tenancy Agreement, can they be evicted

by the Housing Association or will they just get a warning?

The nature of this is that our neighbour's mother who was a (visitor) had racially harassed my partner in an argument we had. It went to court in April 2007 & the mother received a 12 month conditional discharge.
We informed the Housing Association of the court case.

The mother, partner & son arranged a property exchange in Nonvember 2007 and are now living next door to us!
We complained to the Housing Association but they told us they would have been open to a legal challenge if they did not let the exchange go ahead! Our solicitor could not do much either.

Since their move we have had constant harassment & intimidation from the mother and a lot of problems from their son who is about 8 or 9! Now the father is causing aggravation as well!

We have logged everything to the ploice & on incident sheets provided by the (HA) and they have even visited the neighbours regarding all this! The neighbours then have thrown accusations at us!

It appears now our neighbours on the otherside, (we live in a terraced house) has also made a complaint about us! We really don't know what to do & who to turn to, we really feel targeted and ostracised!

Hi Sonak its me again, just a thought, do you know if your housing association has a secure or short hold tenancy agreement? where i live, new tenants sign a temporary contract for 12 months after which they would sign again for a secured tenancy. I know from our neighbours that if you continue complaining (by filling out the incident sheets) the housing association have to apply to the courts to get the tenants out. Make sure you keep complaining to the police, as they have a duty to inform the housing association. This also supplies you with a back up to your claims. Dont worry about the nfh throwing accusations back, stupidly, they have a right to reply to any complaint made against them.
Also, if your able, put cctv camaras up. Weve got them and although you cant film on your neighbours property, these camaras can pick up sound. So if they verbally assault you again, you will have the evidence on tape.
You could also go to your solicitor and see what they can do, maybe an injunction under the protection from harassment law.
Anyway, although this is quite frustrating, you know your not alone.

Hi again ccfluff! Thanks for the extra info you've given me.
I just checked our Tenancy Agreement & in bold at the top it say's Assured Tenancy Agreement and further down it say's an (assured non-shorthold tenancy). I'm trying to get more info on this on the net.

We are looking into cameras as we are not going to take anymore chances!
I just hope we hear something from the (HA) on Monday as we still haven't heard anything since both neighbours on each side have complained about us! If not I think I will have to contact the solicitor again.

I'm happy I've got someone I can relate with as you know what it feels like. Hope you and I get a positive result out of all this!
