my brother was involved in an incident were the outcome was his girlfriend requiring stiches to her eyebrow. the police have yet to arrest him yet there are people who have apparently given statements saying it was him who done it. it happend in the pub and the police claim to have CCTV footage. my brother and his girlfriend claim they don't remember any of the incident as they were both drunk. my brother is worried he will get the blame yet he hasn't been arrested, he has no previous convictions and it in full time employment.

If the CPS decide it is in the public interest to prosecute, and they may not, then a custodial sentence is unlikely for a first offence assuming that no weapon was used. A fine or a community sentence is more likely. Worst case scenario it goes to Crown Court and he gets 5 years but it won't happen.

thanks dave. my brother has spoken to the police on the fone but still not been arrested. I spoke to the manager of the pub and he still has the CCTV footage, the police told him to keep it for a couple of weeks, he has seen the footage and it shows them both throwin glasses at each other, my brother wasn't injured though. i take it glass is classed as a weapon?
