getting my name off a joint mortgage

My husband and I have separated and had a house together which we bought in december 2008, i have left him in the house and he has been paying the mortgage on his own since march 2008. He has not made any effort to get me off the mortgage and so far I am the one that has been making all the phone calls etc, he is continually lying about what he has done in relation to this and is adament that he does not have to remortgage to get me off. I am depserate to get off the mortgage and buy my own property but at the minute it seems my life is in his hands and that there is nothing i can do about it. How can I get my name off this mortgage please!!!??

The mortgage company will need to be satisfied he can afford the mortgage on his own. If they believe he can't, they won't take your name off the mortgage.

Your only option is to sell. If he won't agree to it amicably you can go to court to order the sale.
He would have to remortgage in his own name, and they could refuse to give him one on his own. I had the same prob with my ex!
