Damaged TV

I had to send my TV back to the retailer for repair. I wrapped it with yards of thick bubble wrap and packed it really tightly in a box and sent it with the retailer's courier. Lo & behold the retailer is now telling me it was damaged when they received it!! I said 'take it up with the courier' but they said they can't because it wasn't in its original box, they didn't say this at the time, if they had I wouldn't have sent it! By the way they say the set works perfectly but they can't repair the damage & they are going to send it back to us. Any advice?

you should pursue the courier for the damage caused.

I didn't have any contract with the courier, the retailer arranged it so surely the retailer who should sue them??

your beef is with the courier company not the repairers.
Who broke it?
Why should the retailer sue them for something that belongs to you?

We're not sure who broke the TV we just know it wasn't us! We only sent it because that's what the retailer wanted & they arranged and paid for the courier!
Your transport contract is with the couriers. You need to claim from them.
