Various question, please help before Thursday!!

Hi i was just wondering if anyone can help me, i have court on Thursday 20.09.07 for breaking the 70mph speed limit and going up to speeds of 110mph (apparently!) I did not do this amount of speed so i pleaded not-guilty!! The police have no camera evidence and i was not caught by any type of poilce equipment, they didnt even stop me to make me sign a ticket or something... the only eveidence they have is 2 police officers statements which leads to my first question, on Police oficers statments do the police officers need to have a signature in the witness box next to their signature and also is there a amount of time when they have to write these out cause one of them was done on one day and the other one was done on the next day? the second part is that they reckon they estimated my speed by their speedometre in their patrol car, can they do this and also does their car need calibrating every so often? do they need to record this information?

A police officer does not need to have his witness statement witnessed by another police officer.

They should write out the statements as soon as is reasonably practical for them to do so. If they go on annual leave immediately after the incident, then when they come back is fine - as long as the pocket book entries are contemporaneous.

Yes they can use their own speedometer and yes they are calibrated regularly. Yes, this information is recorded in the service history of those vehicles.

There are several reasons why they didn't stop you - one being that they considered it dangerous to get in to any kind of pursuit situation.
If your speed had have been say 75mph it is unlikely you would have been caught.

Thing is even if the Police were 10% over you would stil have been doing nearly 100 mph.

What speed do you think you were doing?

You can plead your case and hope for the best or plead guilty and show remorse - then you may get a lighter sentence - good luck!
if the court believe the police that you were doing over 100 mph,then you will be banned
Hi, you don't say if you were cautioned or if you have a solicitor? If it was me i would say I was traveling between 70/90mph and hope for the best
The speedometers in Police cars do not require calibration. The officer forms an opinion that your vehicle is travelling faster than the speed limit and his opinion is corroborated by whatever device he uses to record your speed. At 110mph you are in all probability going to get banned and get a hefty fine. If you plead not guilty you will have a hefty costs bill to pay as well.
If they say you were doing 110, then what speed were they doing? And why were they doing that speed if they weren't chasing you?

There's two of them, and one of you - you're bound to be found guilty whether you are or not.

This isn't looking good for you. I'd suggest, if you haven't already, you get yourself a decent solicitor onto the case, especially if you're absolutely certain you're right.

Hi thanks for all your answers, i just wanted to add a little bit more. I went to court back in June and pleaded Not guilty to riding speeds of 110mph but i did say that i may of been doing 80mph at the most as i was overtaking a car and the poilce car came up behind me rather fast so i speeded up a bit to pull in and let them past (they have even wrote that on their statements!!) they then went and stopped 2 others bikes that were in front of me they where done for the same as me and only got 4 points and �300 fine!!!
You should have told the court you were a football player , they would have slapped your wrist and made you do a couple of community matches .........
one law for the rich and one for the common people....
In law it does appear that money does talk .........
