Help - Partner charged with Assault

Can anyone help? My partner and I had an argument about 5 weeks ago and the Police were called solely to remove him from my house because I thought he was having an affair, anyway I wouldn't give him his stuff back and we had a bit of a struggle together, he grabbed my phone and the Police took a statement, which i have since retracted, but they wont let him see me or our children, he has been charged even though I have sent numerous letters asking them to drop the case and he is in Court on Tuesday?? Is there anything I can do, I desperately need him home, and I am so upset about the whole situation. I have a letter to send now which states I exaggerated cos I was upset and angry, what will happen? Nobody will listen to me.

Is this his first offence of this type? Have the police been involved in your arguments before?

Were you injured? How was he behaving in front of the police? Were the children there?
I wouldn't admit you exaggerated, otherwise you may be in very deep water.

The only thing you can do is hope you are not summonsed to court as a "hostile witness".

I am afraid, right or wrong, the police take a positive arrest and charge policy on all domestic abuse nowadays.
The Police take domestic incidents very seriously these days. If they were to take no action and you ended up seriously hurt or even killed (as often happens), they would be accountable to the IPCC. Even if the officer in your case believed it was a one off, he/she would be reluctant to simply drop it, through fear of it happening again. At least if the two of you decide to work on your relationship and it goes pear-shaped, the Police can say they tried to help you. I'm afraid they have to cover their own backs. Good luck though - hope it turns out okay for you.

This is his first offence, Police never been involved before, we have never argued like this before. My arm was slightly bruised from trying to push him out of the door. He was o.k. with Police and yes the the children were around which I realise is bad behaviour from both of us, wont happen again. I am just worried he will be sent to prison, they have him on bail conditions so I cant see him.

I understand the Police need to deal with these type of cases and the system has changed but I just want to put this behind us, I feel so ill with all the stress, and I cant help from a Solicitor. I need to support him, I need to do something. Please any more advice would be greatly appreciated.
