cutting back an oak tree

Can I cut back an oak tree that is overhanging my garden. It is on council land behing the house but only about a foot outside my hedge. It is killing off the hedge and cutting out a lot of light from the garden. I have been told that if I trim it too much they will slap a preservation order on it then I can't even trim it back. Can anyone help please.

It probably already has has a preservation order on it, Why not check with the council anyway, i'm sure they won't mind you trimming it back if you explain the problem.
