My partner left just under two years ago and has had nothing to do with me or our 3 children.
I am now struggling with the mortgage and debts and would like to sell up or re-morgage. How do i do this whilst my partners name is still on the Mortgage and i can not locate them to get this sorted.

The last time we communicated i was told to pay 70,000 or rot in hell we only have 60,000 equity in the property.

I also cant get legal aid as i work?

as the property is in his name, if you fail to pay the mortage, then it is his name and not yours that will get black listed. stop paying and he'll soon want to resolve the situation!

failing that rather radical idea - i would advise you to seek advice from a citizens advice bureau or independent mortgage advisor.
if both names are on the mortgage if you fail to pay it you too will be blacklisted and will jepordise chances of another mortgage. if married you need to sort out ancillary relief. if not married still need legal advice re buying him out. many firms will give first interview for free. also internet is good source of info. for a new mortgage i found moneyquest.co.uk very helpful. goodluck
I got divorced a few years ago, we had to go to court as we were both on the mortgage and he was being unreasonable. The court decided I was to get the house as I was the main carer and he was living abroad and not paying any maintanance. I was given something like 30 days to get a mortgage, which was not easy on a low income as a working single mother.
I did get legal aid though, if you earn too much, can you not cut your hours so you can get the legal aid?

As 'pingping' suggested try the Citizens Advice Bureau. Also contact your Womens Aid, they are fantastic and will help sort out any issues......

There is light at the end of the tunnel, his unreasonable behaviour will only do him harm in the future. Log everything down and he will 'hang himself'. If you are working and looking after your children, you can probably get more help than what you think.
