MRSA - can you sue?

can legal action be taken against an NHS hospital in which a patient (suffering from something totally different) contracts MRSA and dies?

Possibly if MRSA is included on the death certificate. I had a recent discussion with my brother in law on this as he is a coroners officer.. His reply was that no one dies from MRSA.
