Hi, I found this info on a website pertaining to same sex couples but this except specifically deals with what we would call common-law relationships. Cohabiting couples The main legal rights of mixed-sex cohabitants under Scottish legislation are: Recognition as nearest relative (next-of-kin) for the following purposes: The right to a say in your partner's treatment if they become incapacitated or are treated under mental health legislation The right to succeed to the tenancy of the shared home on the death of your partner The right to claim damages from a person who causes the injury or death of your partner Legislation to protect from domestic violence The capacity to foster children jointly as a couple Hope this helps!
There is no such relationship as a `common law` wife or partner. The only way to obtain any type of rights is to go to court for a legal ruling. This will only be given if both partners are free to marry so why not just go ahead and get married?
