Hi Guys,My wife works at a well known superstore and one of the 'colleagues' often drives to work and works under the influence of drink,my question is-does the company have any responsibiities to do anything about this.they know about what she is doing and have sent her home on one occasion but not suspended her someone said she's an alcoholic its an illness! Any comments please.

In my opinion it's anyone that knows anything about her driving to work whilst drunk that needs to be liable to do something! No-one would ever know who it was and she doesn't deserve to have a full time job. I'm surprised they haven't fired her already!
If she driving whilst drunk fair enough someone needs tostop her, but as for her being under the influence at work, that's between her and her employers imho and recoevring alcoholics need all the help they can get and if her employers understand that then good on them.
in my opinion if your wife knows about the driving (which she des) then SHE has a liability to do something about it (eg phoning crime stoppers anonymouslt, talking to the boss) What if the person who was driving drunk ran over a child? or knocked you dowm and killed you? You wife has a responsibility to all the road users out there. Its no good regretting not doing something once a disaster has occurred
Her employers are responsible for her to and from work - its a point of law.
If her employers know she is drunk and send her home I think its possible they are liable if she has an accident.
I think woodchopper is right here, the company is actually responsible and liable.

Unfortunately, the employee may claim that the alcoholism is a disability so they may need to tread carefully
