My boss won't accept my notice

I have recently been offered my dream job, which i have accepted.

I have handed my written notice in to my current boss who is refusing to accept it as i was on holiday at the time, there is nothing in my contract to say that i cannot hand in my notice whilst on holiday.

When i mentioned this to my boss, he lost his temper with me and told me he was disgusted with me leaving him in the lurch just before xmas (i work in catering so we are busy), however i have given the required months notice.

He has told me if i leave before the new year he will tell my new employers that i am unreliable and untrustworthy, can he do this? I dont feel that i have done anything wrong.

My new employers want me to start asap (as soon as my notice is up), which i have agreed to now. My current boss told me to tell them i can't start untill the new year.

Where do i leagally stand in this situation?

you havent done anything wrong. you can hand in your notice anytime you like and your happy to work your notice which sounds like youre doing everything properly.
If you already have the job then does it matter what he says to your new employers. Have you told him where youre going?
If he does do that but probably wont, just explain whats happened to your new employers. They may invite you to start earlier and forget about your notice but make sure you are paid up to date before you make a decision like that. Good luck

Spot on advice - I'd the same. You are legally in the clear - he's trying it on.
I'd also aexplain to your new employees what he's said - I think he's trying it on.

On the last day remind him of the reason you are leaving - your new job being a dream and the old one a nightmare !!

I have spoken to my future boss who has told me that my current boss is notorious for doing this, and they are very happy for me to walk out if he continues to act this way and start immediately in my new job!
Is this not blackmail? Should you not contact the police?

Also, lots of these gadget shops do digital recorders in guises such as pens - these are handy for reccording conversations in situations such as this - just a thought !!
