Hi both, would you please have a look at these links, and tell me what you make of it!...Even though my brother in law was instructed to pay back the sum mentioned in the link, he has made no effort to do so, and has made it known that he has no intention of doing so!.........and nothing at all has been done to make sure that he does......even though he has assets!..............

Your hubby needs to take advice regarding enforcement (of the court order). I don't know the exact terms of the eventual order but given he was ordered to refund at least some of the money, he should do so. I'd take further legal advice - if he is written to and fails to respond, there is no reason why he shouldn't pay the costs of enforcement as well. There are a number of ways that this sort of thing can be enforced. You really need precise legal advice to achieve the right outcome.

Thank you Barmaid, this court case was in May 2010, and nothing has happened really since then, we were told about 2 months ago that the Judge has been consulted again about the case, but he was under the impression that it had been executed, and that he was taking further action to resolve the situation!...........but now still nothing!.............feels like the brother who lost the case is take the mickey!.....And getting away with it!................
