Should They Inform You

I'm referring to clothes fashion only. Are shops legally obliged to inform you, and mark, clothes and shoes that are faulty. I ask this as it seems that lots of sale items seem to have faults of some sort, but have no notification of such on them.

Take a store such as TK Maxx who have a constant stream of designer labels on sale, and yes lots of them are last years fashion, but a lot I look at have faults, but again never marked up as faulty. Many of the shoes have scuffs / scratches. Most shops in the past did have racks of clothes marked as faulty, but you don't see it any more. Has the law changed , or was there never one at all?

IIRC they only have to inform you if the item has been reduced because of the fault and they won't accept a return on it....its not so much that the fault has to be pointed out, its the refusal to refund.
You never see the label 'Seconds' now - at least then you were alerted to the fact there may be a slight fault to look for or ask about.

A lot of the faults on clothes in TK Maxx stick out like a sore thumb, but no notification.
There never was a law about it and shops have never had to point faults out. If you find a fault after purchase you are entitled to a full refund.

In that case barry thanks for the conformation that they don't have to tell you if there's a fault.
But of course the law does insist that items are 'fit for purpose' and of 'satisfactory quality'.

I've come to the conclusion that anything go's on the sale rack in the hope that the customer don't notice the fault, regardless of the fact that if you don't notice the fault on purchase it then cost's time and money to take it back.
