My ex partner recently passed away.We had an amicable arrangement and my son would visit and stay with me regularly. After what has happened, i would like my son to live with myself permanently which is his wish too. I live with my partner and her 2 children. His maternal grandparents have taken him and they are saying they want him to live with them and have stopped me seeing him. Can you please advise me of my rights. There is no parental responsibility order written up.

Your first step is to apply for Parental Responsibility order from the Court. The grandparents might object but to tell you the truth it's all they can do as the Courts pretty much grant them automatically now.


Once you get the Parental Responsibility you can then apply for resedency. That might take some fighting but you should remember that no matter how close your boy is to his grand parents, once you have P.R. your position is more important than that of his grand parents.

Oh, and demand visitation. Threaten them with legal action if you have to but it is your right to see your son.

Your son has already lost one parent why on earth would his grandparents want him to loose another!!!

Maybe because the grandparents have just lost their daughter and the thought of losing their grandson is just to much for them to cope with just now? I understand that you want your son, but please remember that these people are grieving for their child.

sorry, mycats... i know where you're coming from, and respect your ability to 'look over the fence' at the grandparents' feelings... but they are not putting those childrens' interests first and foremost...
