We are due to go to France next week with my b/f's daughter who lives with the mother.Today she says she wont hand over passport,just to ruin holiday, and so we cannot go,but when the solicitor called her she pretended she had lost it.As my b/f has a Parental Rights Agreement,signed by her,can't he apply himself for an emergency passport??

Your boyfriend should phone the UK Passport Service on 0870 521 0410 for advice. They will try to provide him with an appointment at the Passport Office which serves your region. (There's normally a 10 day wait for an appointment but UKPS usually keep a few appointment times spare for genuinely urgent cases).

UKPS will require a signed statement relating to the circumstances of the loss. As it seems unlikely that the child's mother would be willing to provide such a document, I suggest asking your boyfriend's solicitor to provide a signed statement that he has been advised, by the mother, that the passport has been lost.

I also suggest advising the girl's mother that you intend to follow this course of action. Point out that the issue of a new passport will invalidate the 'lost' one. This alone might result in the missing passport suddenly coming to light.

I think you could simplify this by just telling the passport office the passport is lost and you need an urgent replacement. The previous one will be cancelled. The more you enlighten them the more questions they may ask, 'Are you trying to 'kidnap' the child and take her abroad against the wishes of a parent for example.
A friend of mine couldnt find his passport last year and managed to get a replacement in a matter of days, though he did have to go to a main office in Liverpool and queue for a while.
