Injuries To Shoulder Whilst Connecting Red Airline

I was injured whilst using a road unit to do a yard shunt job, a job which I’d done using a road unit for 14 years. The injury accrued when the airline backfired due to pressure in the airline. My company H+S insist there has never been any other reported accidents of this nature, in the uk or even world wide. Does anyone have an example or 1st hand knowledge of injury that’s happen due to this type of work or or using compressed airlines on a road unit to carry out a yard shunter duties

You don’t say how bad your shoulder injury is, but if it is likely to result in long term disability/pain then you should consider obtaining compensation for your injury. It does not matter that no one else in the world has suffered such an injury – you have suffered the injury.

Although not a lawyer, I would suggest that claiming a type of accident had never happened before is a very poor defence – otherwise the first person to suffer any type of accident would be barred from making a claim for injury.

You don’t say how bad your shoulder injury is, but if it is likely to result in long term disability/pain then you should consider obtaining compensation for your injury. Bear in mind that any compensation amount awarded may be reduced if it is shown that you did not follow work procedures; and as I have posted to others, suing your employer is unlikely to make you employee of the month anytime soon.
