Hi, I have been in a orange business contract for 2 years which originally ended 01.07.2011. 3 months before it was due a 3rd Party company called me asking if I would like to try out a phone. This phone never arrived so presumed they were all talk. In April my phone got cut off on the Friday and called Orange, they reverted my sim card back to how it was and I requested that they did not change my contract without my consent as I have a password before I can make changes.
About 3 weeks later this happend again but this time the Orange operative said I would need to contact the 3rd Party, they gave me their details and I phoned them. The saleman told me the phone had been sent, I asked where and he told me a address I lived at a year ago. I have contacted the tenants who claim no phone has been delivered. The 3rd Party (NWM) say they have a copy of the signed package but this is not the same signature as the tenant.
Orange keep telling me the 3rd party have to cancel the contract with them. I have told NWM I do not want to deal with them as I am not willing to accept a second hand phone out of the office drawer as a alternative.
Orange's latest is that they have escalated this to thier business support but every time I call them they keep saying it will be dealt with within 48 hours... it has now been a month.
I have now cancelled the direct debit to hopefully get them to do something.
I have been patient as I dont want to loose the number as it is for business and have been patient with Orange as I was happy to deal with them direct and even have a second contract with another provider I am willing to change to them as it has now ended.
My question is..
How does this case affect distance selling rights?
What should I do next?
If I stop paying Orange and cancel with them will the case be on my side if it goes to court?
