Why not just give it her back if she bought it and still owes money on it, that would be the normal thing to do tbh? No idea about your question though.

I think it is a bit mean to keep it and sell it, when you know your ex-girlfriend is still paying for it. Do the decent thing, and give it back to her.

Activate what? the phone? No.
Ah.. I see the question. If THEY bought the phone online, could they use it? Yes. Unless your Ms has reported it stolen or lost.

Any phone is just a device.. (you can direct debit a device with monthly instalments) it is up to the sim if it will allow it to be "activated".

The only way the phone won't work is if it is reported lost or stolen and then confiscated by the 2nd hand seller.
or if the phone is set to a different network than the one trying to be accessed by the 'newly' inserted sim
