I ordered a bed for my son over the internet but it arrived without the tent (out 0f stock), the ladder will not fit on the side we want it and the base slats that hold the mattress dont screw into both sides of base rail. Are we entitled to a full refund or do we have to accept a replacement. I dont want a replacement because I can see the same problems occuring and my six year old doesn't want to wait another 5 weeks for his birthday present. Where do we stand legally?

You can reject the goods - basically the item should be fit for purpose, and this obviously isn't because you cannot assemble as you thought when buying it.

There is also a law governing purchases via the internet- I cannot remember the detail - but it covers you because you are viewing the goods via your PC and not in a shop. From memory it allows rejection of the goods, with a full refund, within (I think) 14 days.

The problem is that once the Company have got your money its difficult for you to get it back on your terms, and is made more difficult because you are not dealing with a shop on the High Street.

Have you tried a Google search "law for faulty goods bought over internet".

Hope this helps & good luck

Just found these couple of answers on Google - they confirm your entitlement to a full refund.

I want a refund because Ive changed my mind about something I bought. What are my rights?

You are not entitled to a refund just because you change your mind or decide the item is unsuitable or does not fit. If the shop offers either a refund, exchange or credit note, then this is more than you would be legally entitled to.

If you are worried, ask about refunds when you buy the goods. You will be entitled to a refund if you were told you could have one at the time you made the purchase. We recommend that you get agreements like this in writing, in case you need to prove it later on. Ask the trader to write it on the receipt.

If the goods you buy are not either:

as described
of satisfactory quality
fit for their purpose
then the law says you are entitled to return them. Whether you are entitled to a full refund depends upon how long you have had the goods. Even if you are not entitled to a full refund you will still be entitled to some recompense.

Ive changed my mind but already paid a deposit and the shop won't give me my money back. Can they do this?

When you place an order and pay a deposit, you enter into a contract with the shop. They took your deposit as security and proof of your good intentions. As you are breaking the deal, you will probably lose the deposit.

I want to return some goods bought over the Internet what are my rights?

When you buy goods via a distant means (i.e. phone,Internet, catalogue) you are legally entitled to a seven day cooling off period. If the trader will not take the goods back within 7 days and he does not refund you within 30 days please report them to Trading Standards.

Here's the official government information sheet, from the DTI:

If the bed cost over 100 and you paid by credit (as opposde to debit) card, then your credit card company has an equal liability with the supplier.

You can cancel your order with the supplier and tell them that you are returning the goods under the distance selling reglations. Also tell your credit card company. They have 30 days to refund your money.

Thanks everyone!!

Problem almost solved. The Manufacturer of the bed rang us and gave excellent advice on how to rectify the problems we were having with the bed. They are sending replacements for the faulty parts as soon as possible. Excellent after sales service!!

The manufacturers are Thuka. I would definitely buy there products again.
