Tracking Cookies - are you supposed to be warned about them?

I find tracking cookies on my computer after visiting a site called gardenlaw , I was under the impression this site was safe yet my spyware finds tracking cookies from that site. Is it legal to use tracking cookies and not state this on the site? I am very disappointed as this site is useful but I feel this invasion in privacy makes gardenlaw not so lawful?

It might not be a tracking cookie possibly.

A lot of websites place cookies on your computer as part of their usual everyday operations (e.g. to speed up logging in) While they are not necessarily malicious the website will install the cookie without actually explicitly telling you it is doing so.

Spyware programs should usually recognise the harmless type of cookie, but they can't recognise them all. And if it doesn't recognise it, it will probably just assume it is something nasty.
