Dear all,

what is the legal requirement regarding the use of recording equipment in patrol vehicles? I have found the following but it was valid in 2001! please help

Chief Inspector Peter Fouweather, who's in charge of Gwent Constabulary's Traffic Department, their traffic procedures state that if the ProVida video recording equipment is installed in the patrol car and the Traffic Officer is qualified to use the equipment then it must be recording whenever the vehicle is being driven.

There's no legal requirement whatsoever. The quote you've provided refers to the procedures of a particular police force. (i.e. if an officer of that force failed to ensure that the equipment was switched on he'd be guilty of an internal disciplinary offence but not of a criminal offence).

In that case how do I find out the procedure of the particular police force in question, namely the Hampshire constabulary?

Additionally should there not be some sort of general guidance in case prosecution cases collapse due to lack of corroborating evidence gathered by the traffic cops!? where do I find this info and its legal implications?! I am in particular interested if there were any case laws where it was deemed unsafe to proceed based on a sole witness statement by the police officer without any further souce to support the claim?! if I can find this I can prove my innosence as the police officer in my case made a mistake and I have no way of proving it. HenceI have to concentrate on fighting my corner on legal grounds.
