Cosmetic damage to new portable media player

I've just got a brand new Archos 605 portable media player and took it out of the house. I put in the official Archos slip case that came included.
When i took it out of the case there was a dirty smudge about an inch wide on the casing just below the screen which wasn't there when I put it into the case.
Its degree of visibility depends on the angle you hold the player at but I know it's there and its irritating for such a new item.
Would I be entitled to a replacement?
